Permitted Development
Permitted Development gives clients the ability to perform certain types of work to their home without applying for full planning permission. It is always best to check with your local authority if work does fall under this, as often the same type of work won’t apply to flats or commercial buildings. Some ‘designated’ areas in the UK are more restrictive with permitted development rights, these are often Areas of Outstanding Natural Beauty and Listed Properties.
Common ideas for projects that fall under permitted development are single storey rear extensions which, for a detached property, can be up to 8m in depth, providing they are 2m away from the boundary. If your property is either semi-detached or a terrace property then you are limited to an extension that is a maximum of 6m. The height of these must also not exceed 4m. Two-storey extensions are also considered under permitted development however they need to be 7m away from the rear boundary and no more than 3m in length from the original wall. However with new extensions you are not allowed to cover over 50% of the land around your house, and outbuildings are included in this coverage.
Most loft conversions also fall under permitted development rights providing they don’t exceed more than 50m3 in a detached house or 40m3 within another type of property.
There is a vast array of home modifications that can be made under permitted development from basic internal alterations or building a porch, to two-storey rear extensions or single storey side extensions or the construction of a single-storey outbuilding. For permitted development projects the new extensions must also be made from similar materials to the original house.
Most permitted development rights are subject to conditions and limitations.
One such condition on certain classes of permitted development is the need to apply to the Local Planning Authority for its 'Prior Approval'; or to determine if its 'Prior Approval' will be required.
This allows the Local Planning Authority to consider the proposals, their likely impacts in regard to certain factors (e.g. transport and highways) and how these may be mitigated.
